*Right now under present law, EZ Pass Fines and Penalties are frequently dischargeable in bankruptcy. But with states and cities desperate for money, the law could change. In addition, cities and states can change the existing law and allow for license suspensions. But under Chapter 7 of the US Bankruptcy Code, fines, penalties, or forfeitures payable to and for the benefit of a governmental unit are not dischargeable. Nonetheless, because the MTA and PA are not solely governmental agencies, my office has been successful in discharging both tolls and accrued penalties. However, this language has yet to be challenged as applicable by the MTA and PA, and consequently we cannot guarantee that we will be successful in discharging those violation debt in the future despite our best efforts.*
